    Hehehe... those dam artists are always getting the shaft and swiftly thrown under a bus.

    As a designer I understand how this happens.
    We wait around to get images from our clients that never come.
    When and if they do, are such poor quality you cant use them in web situations let alone for press runs.

    I have learned to use Pink boxes for image place holders, rather than using lowrez or stolen FPO images.
    The client gets sick of looking at the pink box's on proofs and gets image issues resolved very fast.

    Anyway... glad you have received contact Matt and one issue is somewhat resolved.

    I wrote to their company page on Facebook and told them it was illegal to use other people's photos.
    Someone wrote back and said I had not told them WHICH photos.

    I wrote back again and said if you did not take the picture yourself, you should not use it.

    Different countries, different standards.

    There is a real difficulty here. Unfortunately for those who want to protect their images there are no common copyright arrangements despite fairly comprehensive international agreements on copyright. The web makes it worse, as there are issues as to the laws affecting operation of the web in different countries. The law which applies may relate to the country in which they are hosted, the country from which thy are uploaded, or the country in which they are downloaded.

    In addition there are different approaches to between countries. For example, there are even subtle differences between Scotland and England (currently both in one nation but with two legal systems).

    Embedding a watermark in the image seems to me the only real way at the moment that you can at least ensure images you post on the web are acknowledged when being used by others and as has been noted here, that is not an absolute protection.

    In most cases where some copyright protection applies, the copyright of a photograph (as with any else) rests with its creator, that is, the photographer. A Photographer may grant his/her copyright to others (for example the person paying for the photograph) but copyright is retained by the creator.

    Publishing to the web does not change this. Sadly many people think that photos on the web are in the public domain and therefore copyright does not apply, simply not the case. If you don't want your images re-posted without at least some protection, then you need to add a little line of copyright text to the image or some acknowledgement of the creator of the image. It won't stop other people using them but at least you are better able to point it out.

    I wonder if it's the word "defunct" itself or the phrase "defunct Highland Clans". I'm assuming the reference is about stealing photos from a shop called "Highland Clans" which is no longer in business, not about stealing photos from actual Highland Clans which no longer exist

    Sorry for being somewhat vague,
    I wasn't more specific as they've had their images stolen time and again, which has been referenced in threads of this nature.
    It's sometimes easy to forget that not everyone has been following this particular topic for the same amount of time.
    The particular business was called "Highland Clans" and has shut it's doors.
