	In the USA?  Yes.  You start running into trouble when you sell it, though.  As long as you make it for your own personal use, and the use of your friends, you can make your own booze until you turn green.

	There are actually limits.  I don't know about distilled products, but you are leagally only supposed to make 50 gallons of beer (don't know how anyone would know, but it is the law).

			No Red Oak Casks.
		
			
				
					The oak casks used to mature Scotch whisky have been used previously for maturing Bourbon (mainly) or other spirits, such as sherry or wine.
 95% of the these casks are made from American white oak.

 According to the Epicurious website,  "The favorite wood for wine barrels is white oak (red oak is too porous), with the U.S. species differing slightly from European"
