[B I was wondering if anybody could tell me why my browser refuses to let me see any of the sample pics of the kilts or tartans on Frugal Corner's page. Is a setting wrong on my computer?[/B]

It took a while for the photos to load on my computer, so you might have to give it more time.

First NEVER design a webpage at midnight-I have made corrections to the 2 tartans and will reload page later
We have not carried the Irish national because it carries a trademark/copyright which is in place in the USA - at least to our understanding
-as far as the Pride of Scotland there seems to be no trade mark in place - now I will say if we are apprached by a representative of the company and it stands up..we will remove those products..

Tartan is not protected by statute, even in Scotland. However there are commercial steps that might be taken to protect a given tartan. The design might be copyrighted, though this could be difficult to enforce even within states complying with the Berne Convention. The woven cloth might be registered under the UK Design Act and this can lead to punishing compensation if others manufacture it, within a UK context. Also, the name of the tartan might be trademarked for the tartan product, within relevant national regulations, but then the design itself is not protected with the name."
Now We have run a search on the USPTO (United States Patent & Trademark Office) and there are not trademarks on Pride of Scotland
Also a search of the copyright office shows no copyrights
I have at least 10 books that show tartans by clan and also some corporate tartans-depending on the one you look at- the colors will vary at least to a certain degree and in some cases they may vary greatly- some tartans are older or newer and may not be recognized by the current Clan Chief, Some setts are bigger, some smaller, some colors darker, some stripes wider some thinner
in most cases we try to make sure we are selling a product which is as close to the originally as can be.

All I can tell you about the Pride of Scotland tartan is that the notes in the STA file read: "Design owned by MacColl's of Aberdeen. Woven exclusively by Lochcarron of Scotland."
I know Lochcarron used to sell it to all their retailers, but that stopped a couple of years ago. I just last week recieved a phone call from a woman looking for this tartan. She had called Strathmore directly (apparantly they also used to weave it because she her husband's kilt in that tartan, which she was trying to match, had a Strathmore label). Strathmore told her that they could not provide the tartan any longer because it was a proprietary tartan of MacColl's. From what she said, quite a few places she called told her the same thing. I suggested -- big surprise here -- that she call up MacColl's!
Anyway, whether or not their copyright can be effectively enforced in the United States is a different matter than whether they in fact are the owners of that design.
In any case, they are not as likely to bother you about it as they are the manufacturers of that tartan. You don't weave the tartan, you purchase it from another supplier. They are the ones who really need to be on the ball about this.
I know there are a lot of Ebay sellers who also offer this tartan in synthetic material kilts. It's quite a popular design. There may not be anything MacColl's can really do about it. But I bet they aren't thrilled.

Ok, I really don't mean for this to be "pick on Frugal Corner" day, but the more I look at your web site the more I notice. I hope you don't mind me pointing these things out as I find them.
I know on your web site, in the FAQ section, you indicate your desire not to infringe on anyone's intellectiual property rights. You say, "We will never sell Balmoral Tartan or any tartan which is trademarked." That's admirable.
So since we are on the subject, regarding the Pride of Scotland tartan, you also offer the Isle of Skye tartan. If you look up the Isle of Skye tartan in the International Tartan Index (STA), it says:
"Instigated and registered by Mrs Rosemary Nicolson Samios in 1992, an Australian of Skye descent, now living in Skye. It was selected through a worldwide competition won by weaver Angus MacLeod from Lewis who produced the first commercial quantities in traditional kilt weight in 1993 at Lochcarron Weavers in North Strome... Mrs Samios controls the rights to the production of this 'Isle of Skye' district tartan through registration with the Patents Office and Lochcarron of Scotland has been appointed as the supplier of fabrics and woven accessories in this tartan."
Just so you are aware. Also, I couldn't help but notice that you make use of the Royal Arms prominantly at the top of each page in your name banner. Looks great. But you might want to read this page:

HOW DO BUSINESSES APPLY TO USE THE ROYAL ARMS?
The Royal Arms may only be used by businesses which are holders of a Royal Warrant. Royal Warrants are a mark of recognition that tradesmen are regular suppliers of goods and services to the Royal households.
Strict regulations govern the warrant, which allows the grantee or his company to use the legend 'By Appointment' and display the Royal Arms on his products, such as stationery, advertisements and other printed material, in his or her premises as well as on delivery vehicles.
The Royal Warrant Holders Association is the organisation which co-ordinates the system of Royal Warrants, under the guidance of the Royal Household's Lord Chamberlain's Office.
Over here in the US, most people probably wouldn't know the difference (though a large portion of those into kilts might be aware). But in the UK, use of the Royal Arms without a Royal Warrent would be considered a very serious matter.
Again, I apologize if I sounds like I'm being overly critical of your site all of a sudden. To be honest, today's the first time I really took a close look at it, when looking at those tartan images. I just wanted to share with you some of what I noticed that I think you should be aware of.

One thing about being a public company is that folks look at what you do and if it is incorrect they will take note and in many cases tell you. I have no heart burn at all with your comments, suggestions, or even complaints.
Somebody also mentioned the royal arms - I am going to replace it with a rampant lion-
