Whew, I got the Answer. You don't have to go home! You just have to have a ticket out of the country. Get a cheap ticket to Canada from Seattle and then you can just hop across the border every ninety days until you can get it sorted.

Anything that shows you can move on and aren't stuck in the U.S. should suffice, even a train ticket to Canada from Boise might do.

Unfortunately I can't do that, either. They specifically must see that you have returned to your country of origin before coming back in.
HOWEVER... I may be able to get a loan and that would sort out the whole problem.
I am just filling in the paperwork and I will know in just over a week.

Arlen, I'm sorry to hear about your latest setback. Really, that's all it is-- a setback, a minor delay. You'll get here eventually!

It's sounds to me like you're already getting it worked out. Keep trying, and good luck!

Yes that's how the waiver works.

You are allowed to do cross border travel during the 90 days and re-enter on the same waiver with the date stamp on your passport and the pink slip you get on original entry. I went into Canada and back on two separate days with this.

This pink slip is collected when you go through passport control for your homeward flight and your exit details are then on the system. This proves you have not overstayed. Without this proof it can create complications entering with a later waiver.

Best of luck with the paper work Arlen, getting it right is surest and safest and worth it in the long run.

Arlen = I'm really sorry to hear this. As an immigrant myself I know the difficulties and frustrations dealing with the Immigration and Naturalization Service. And since 9/11 the system seems to have got slower and more difficult. I presume Diane is applying for your admission under the I 130 Petition for an Alien Relative. The good news is that once that petition is approved, there should not be any wait for a visa.

So hang in there, there is a silver lining waiting for you in Idaho!

Sounds like a good reason to spend a week in the BVIs.

Did you ask the company that sold you the original ticket if they could convert it to an open round trip ticket?

I am sorry to hear of your trouble Arlen, it must be very frustrating. I am sorry that I can not give any beneficial advice to you, but I will keep good thoughts for you, your wife and dear little Pip!!
Good luck and hang in there,
