In my opinion, the penalty for this illegal action should be severe, so that other vendors who feel they are above the law get the message. And as Todd, mentioned, the same thing happens with the Irish National We have Stillwater Kilts doing it the right way - Jerry obtained the rights from the House of Edgar to have the Irish National woven out of synthetic material, while other vendors were selling it under a different name.

I spoke with someone on the Royal Mile today who told me that this was only the first publicised court action but there are other pending actions in the courts against the Gold Bros empire for breach of copyright.
But the biggest problem was that most of the smaller Scottish manufacturers cannot afford to go to court against these people after their designs are copied becuase they simply cannot afford the legal costs of doing so or have not infact registered trademarks on their designs due to the costs involved.

It would be a frugal measure indeed if these companies would stop trying to corner the growing IOS market.

Locharron claims to be the only mill licensed to produce Isle of Skye, but I thought Marton Mills produced it too...
I wonder if other companies could get in trouble for using counterfeit tartan?

I noticed that too. But, Marton Mills pays royalties to do so. I believe this was just an error in the article.

Isle of Skye is still available on their website! You'll have to act fast though!

Well well well.
Few of the tartans that GB tout will have been so copyrighted and patented but looks like they have landed themselves in trouble with this one.
The copyright is clearly stated on the STA website so I don't think they can claim ignorance.
So let's hope that any other weavers of this tartan have a licence from the copyright holder or they might be in trouble also.
And in the case of a tartan it's not just the case of the name but the colours and the thread count.
I am sure that sellers of the legitimate product will be rubbing their hands with glee

Do I sense that people are taking glee at the misfortune of others most deserving?
